“Alienation of
Affection”
Definition: Elements. A cause of action for alienation of affection
consist of three elements: 1) wrongful conduct of the defendant; 2) loss
of affection or consortium; and 3) causal connection between such conduct
and the loss. The cause of action exists either where a spouse is enticed
away, in which case the cause of action is complete , or where the one
spouse leaves the other voluntarily and without such enticement, but
its enticed, persuaded, force or otherwise made or led to stay away. An
attempt to alienate, however, must be successful to be actionable.
