“Constructive
Trust” Definition: A kind of “trust” impressed
by courts of equity upon title to property n favor of the defrauded party
where a person obtains legal title to such property by fraud or
concealment. Such trust is not a trust at all in the strict and proper
signification of the word “trust”. A trust created in favor of a person
who is defrauded by another who acquired title to property through
misrepresentation and breach of trust.
